Can nonqualified deferred compensation plans brave our new world?

Section 409A has given the IRS new abilities to monitor nonqualified deferred compensation plans (NDCPs). Coupled with the recent economic situation and increasing public scrutiny of executive compensation, the new legislation is leading many employers to question the viability of NDCPs. While designing an acceptable NDCP is now more challenging than ever, the plans can still be a good option for employers, executives, and shareholders alike.
